1. About These Terms

This website and the services offered through it are operated by HEAVEN HOUSE LLC, referred to as “Heaven House”, “we”, “us” or “our”.

By using this website, placing an order or purchasing a service, you agree to these Terms & Conditions together with any package description, quotation, project scope, Privacy Policy and other terms presented to you before purchase.

If you do not agree with these Terms, you should not purchase or use our services.

2. Our Services

The exact scope of a service is determined by the package purchased, the product description, a written quotation or another written project agreement.

3. Orders and Service Purchases

Services may be purchased directly through our WooCommerce store or agreed separately through a custom quotation.

When placing an order, you are responsible for reviewing the service description, price, scope, exclusions and any relevant requirements before completing payment.

An order confirmation does not mean that requirements outside the listed scope have automatically been accepted.

4. Payments and Prices

Prices shown on the website are the prices applicable at the time of purchase unless otherwise stated.

Payment must be completed using the payment methods made available during checkout or another payment method agreed with Heaven House.

Where taxes, transaction fees, currency conversion charges or other legally applicable costs arise, they may be charged separately where appropriate.

We may change future package prices without affecting services already purchased and paid for.

5. When Work Begins

Payment alone does not always mean work can begin immediately.

A project may require information, content, access credentials, advertising account permissions, technical details, branding materials, approvals or other items from the client before work can start.

Project timelines may begin only once the information reasonably required to begin the agreed scope has been provided.

6. Client Responsibilities

You agree to provide accurate and timely information necessary for us to perform the purchased service.

Depending on the project, you may be responsible for providing:

• Website, hosting or CMS access.
• Google, Meta or analytics account access.
• Business and service information.
• Product information and prices.
• Branding materials and logos.
• Images, videos and content where required.
• Legal texts, policies and regulatory information relevant to your business.
• Feedback and approvals within a reasonable timeframe.

Delays caused by missing access, information, content or approvals may extend the project timeline.

You confirm that materials supplied to us may lawfully be used for the project and do not knowingly infringe third-party rights.

7. Project Scope and Additional Work

Our obligation is limited to the scope described in the purchased package or agreed project specification.

Requests outside that scope may be treated as additional work and may require a separate payment or quotation.

Examples of additional scope may include:

• Additional website pages.
• Additional products or content entry.
• New website functionality.
• New API integrations.
• Major design changes after approval.
• Additional advertising platforms or campaigns.
• Extensive content writing.
• Migration or data work not included in the package.

8. SEO Services

SEO services are intended to improve a website's search visibility through technical, structural, content and keyword-related work within the purchased scope.

Search engine rankings are influenced by many factors outside our control, including search engine algorithms, competition, website history, content quality and changes made by third parties.

Search engines may update their algorithms or indexing systems at any time, which may positively or negatively affect website performance.

9. Google Ads and Meta Ads Services

Advertising packages cover campaign management services according to the purchased scope.

Unless explicitly stated otherwise, the package price does not include the actual advertising budget paid to Google, Meta or another advertising platform.

Advertising spend

The client is responsible for maintaining sufficient advertising budget and valid payment methods in the relevant advertising accounts.

Campaign results

We do not guarantee a specific number of leads, enquiries, sales, conversions, impressions, clicks, ROAS or other campaign outcome.

Advertising performance depends on factors including market competition, budget, offer quality, landing pages, creative assets, audience, platform algorithms and customer behaviour.

Account restrictions

Google, Meta and other advertising platforms may suspend, restrict or reject advertising accounts, campaigns or advertisements under their own policies. Such platform decisions are outside our direct control.

10. Website Development

Website packages include only the pages, sections, functionality and revision rounds stated in the relevant package or agreed project scope.

Unless specifically stated, website development packages do not automatically include:

• Domain registration.
• Hosting fees.
• Paid premium plugins or licenses.
• Professional photography or video production.
• Large-scale copywriting.
• Unlimited product entry.
• Ongoing SEO management.
• Ongoing maintenance after project completion.

Browser, device and third-party software updates can affect website behaviour after delivery. Ongoing maintenance may require a separate service.

11. Software Development

Software development packages represent a defined scope or starting scope for development.

Custom software requirements can change significantly after technical analysis. Where the requested functionality exceeds the purchased package, additional development fees may apply.

Third-party systems

Software projects may depend on APIs, external platforms, hosting providers, CRM systems, payment providers or other third-party technology.

We are not responsible for changes, restrictions, outages, discontinued APIs or policies introduced by those third-party providers.

Maintenance

Unless expressly included, ongoing software maintenance, future updates and new feature development are separate from the original development scope.

12. Revisions and Approvals

Where a package includes a specified number of revision rounds, those revisions apply to reasonable changes within the originally agreed scope.

A revision does not mean an unlimited redesign, replacement of the original project direction or addition of new functionality.

Requests made after the included revision allowance has been used may be charged separately.

If you approve a design, page, feature or other deliverable and later request substantial changes, those changes may be treated as additional work.

13. Third-Party Services and Costs

Some projects rely on third-party products or services that are not owned or controlled by Heaven House.

These may include:

• Hosting providers.
• Domain registrars.
• Payment gateways.
• Advertising platforms.
• Premium WordPress plugins.
• Software licenses.
• APIs.
• CRM services.
• Stock image or media providers.
• Email and cloud services.

Unless specifically included in writing, fees charged by third-party providers are the client's responsibility.

14. Delivery and Timelines

Any project duration or delivery estimate is an estimate unless a fixed deadline has been expressly agreed in writing.

Timelines may change because of:

• Delayed client feedback or approvals.
• Missing content or access.
• Additional work requested by the client.
• Technical limitations discovered during development.
• Third-party provider delays.
• Platform reviews or advertising account approvals.
• Events reasonably outside our control.

We aim to communicate material project delays where reasonably possible.

15. Intellectual Property

Each party retains ownership of intellectual property that it owned before the project began.

You retain ownership of your existing logos, brand assets, business information, products and materials supplied to us.

Subject to full payment, rights in custom project deliverables created specifically for you may be transferred or licensed according to the nature of the project and the agreed scope.

Third-party software, plugins, frameworks, fonts, themes, libraries, stock media and other licensed materials remain subject to their respective license terms.

General knowledge, methods, reusable code components, development techniques and non-client-specific know-how may remain with Heaven House unless otherwise agreed in writing.

16. Account Access and Credentials

You may provide temporary or ongoing access to websites, advertising accounts, analytics platforms or other systems so we can perform the agreed services.

You remain responsible for account ownership, account recovery methods and maintaining appropriate security over your systems.

We recommend using role-based access, separate user accounts and secure password practices where available.

17. Results and Warranties

We aim to perform services with reasonable professional care and according to the agreed scope.

However, digital marketing and technology involve external systems and variables that cannot be fully controlled.

Except where required by applicable law, we do not guarantee:

• Specific SEO rankings.
• A fixed volume of website traffic.
• A specific number of advertising leads or sales.
• Continuous availability of third-party platforms.
• Permanent compatibility with future third-party updates.
• A specific commercial return from a website or software project.

18. Limitation of Liability

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under applicable law.

To the extent permitted by law, Heaven House will not be responsible for indirect, incidental or consequential losses arising from the use of our services, including loss of anticipated profits, business opportunities or revenue.

We are not responsible for losses caused solely by third-party platform outages, account suspensions, algorithm changes, external cyber incidents, client modifications, incorrect client information or unauthorized changes made outside our control.

Any limitation of liability in these Terms is subject to applicable mandatory consumer protection rights. 19. Suspension or Termination

We may suspend or stop work where reasonably necessary, including where:

• Payment remains outstanding.
• Required information or access has not been provided for an extended period.
• The service is being used for unlawful activity.
• The client requests activity that breaches platform policies or applicable law.
• Abusive or threatening conduct makes continued service unreasonable.

Any financial consequences of cancellation or termination are also subject to our Refund & Cancellation Policy and applicable law.

20. Applicable Law and Disputes

These Terms are intended to operate subject to the applicable laws and regulations of the United Arab Emirates and any mandatory rules that apply to the relevant transaction.

Nothing in these Terms is intended to remove rights that cannot lawfully be waived under applicable consumer protection legislation.

Where a dispute arises, the parties should first attempt to resolve it through reasonable direct communication before pursuing other available remedies.

21. Changes to These Terms

We may update these Terms & Conditions when our services, packages, website functionality or legal requirements change.

The version applicable to a purchase will generally be the version made available at the time of that transaction, subject to mandatory law.
